Notice of Assignee Sale: Intellectual Property of OCHO Candy, Inc

OCHO Candy, an organic fair trade chocolate confection manufacturer, ceased business operations and entered into an Assignment for the Benefit of Creditors on February 8, 2024. The Assignee is now soliciting bids for the acquisition of OCHO Candy’s portfolio of intellectual property.

About OCHO Candy:

OCHO Candy was an organic chocolate confection manufacturer that operated out of Oakland, California up until early 2021 when operations were outsourced to improve margins. OCHO manufactured delectable chocolate bars and minis with a variety of flavorful fillings which were hand-crafted in small batches, using only high-quality organic ingredients. All of their candy is vegan and dairy-free and they have a line of plant-based caramels. OCHO was sold in most large retailers including Costco, Whole Foods, Target, Kroger, and Walgreens among others.

Opportunity:

The available intellectual property portfolio includes the OCHO brand & name rights, packaging designs, website domains, social media pages, and most importantly all the Company’s proprietary chocolate candy recipes which include the following flavors:

Submission of Bids:

All interested parties wishing to make competitive offers for the Assets must submit a qualified bid to the Assignee for the Benefit of Creditors no later than April 19, 2024, at 5:00 PM Central Time. Upon execution of a confidentiality and non-disclosure agreement, interested parties will be granted access to a virtual data room to review the available diligence materials. To ensure a transparent and fair bidding process, all interested bidders must adhere to the submission guidelines and deadlines. Further details regarding the processes and procedures for conducting diligence and submitting bids, including the necessary documentation and bid format, will be provided upon request.
