PUBLIC NOTICE OF CHAPTER 11 SALE: INMET Mining, LLC

NOTICE OF 363 BANKRUPTCY SALE

INMET Mining, LLC (“Debtor”) filed for chapter 11 bankruptcy relief on April 5, 2023 in the United States Bankruptcy Court for the Eastern District of Kentucky, Case No. 23-70113.

The Debtor is selling its mining operations in both Kentucky and Virginia described below in two separate 363-bankruptcy sale auctions on Thursday, July 6, 2023, with any successful bid subject to Bankruptcy Court approval:

(1) substantially all of the Debtor’s Assets predominantly located in Kentucky, or a subset thereof, including certain executory contracts and unexpired leases (the “Kentucky Assets”); and

(2) all assets of the company located predominantly in Virginia involving the Pigeon Creek Processing Plant and Osaka Mine, including certain executory contracts and unexpired leases (the “Pigeon Creek Assets”).

As part of the sale, the Debtor may be seeking to assume certain executory contracts and unexpired leases and establishing cure amounts. Your rights may be affected if you are a party to a contract or lease with the Debtor.

Indications of interest for the Kentucky Assets are due June 20, 2023 and the bid deadline for both sales is June 30, 2023 at 5:00 p.m. (Eastern). If more than one qualified bid is received for the assets, auctions will be conducted at the offices of counsel to the Debtor, Jackson Kelly PLLC, 100 W. Main Street, Suite 700, Lexington, Kentucky, on July 6, 2023 at 9:00 a.m. (Eastern).

Objections to the Sales are due on or before July 10, 2023. A sale hearing for both sales is scheduled for July 12, 2023 at 9:00 a.m. (Eastern), in the United States Bankruptcy Court for the Eastern District of Kentucky, 100 East Vine Street, Suite 200, Second Floor Courtroom, Lexington, Kentucky 40507. The Kentucky Assets may be subject to an expedited sale hearing.

The claims bar date deadline is July 19, 2023, at 11:59 p.m. (prevailing Eastern Time) for non-governmental units.
