Is Your Law Firm in Trouble?

A number of large law firms have filed for bankruptcy over the last couple of decades. These include Brobeck, Heller Ehrman, Coudert Brothers, Thelen, Howrey, and Dewey LeBoeuf. Whether you are a client, vendor, employee, or partner of a bankrupt law firm, you should know that a law firm bankruptcy is different from the bankruptcy of many other other businesses. Here’s an example: A client hires Partner Pam at law firm Rabinowitz, Rabinowitz & Rabinowitz for a significant matter that will take years to complete. A year later RRR files bankruptcy. Partner Pam, not being prohibited by a non-compete (non-competes aren't generally used for lawyers because they are generally not enforceable against lawyers), leaves RRR and moves over to Bendini, Lambert & Locke, taking the client with her. At the time of the move, the client owes RRR a lot in legal fees. Pam and other lawyers start billing the client at BL&L upon her arrival there. See how some issues may arise?
