Assume you have a first priory lien on all of a
chapter 11 debtor’s assets. Assume further that you
are owed $50 million, all the debtor’s assets sell
in bankruptcy for $25 million, that there is a
junior secured lender who is owed $10 million, and
that trade creditors are owed $5 million. In the
context of a chapter 11 plan you want to let the
trade creditors have $5 million of what would
otherwise be distributed to you despite the fact
that the junior secured creditor will get nothing.

Will Look a Gift Horse in the Mouth” to find

A virtual, on-line symposium for business owners,
corporate directors and officers, private equity
professionals, and others seeking to learn the ins
and outs of dealing with a financially distressed
company – whether running one, buying one, or trying
to get paid by one. This three-part webinar series,
co-produced in cooperation with eight leading trade
organizations, is unprecedented in scope, format,
and participation. For more information or to

DailyDAC’s ODD curates information about distressed
companies and assets of distressed companies that
are for sale or that are likely to become for sale.
No other service is as complete or as speedy. Public
and other large companies get plenty of attention
when they become distressed. The smaller ones -
those in the vast middle market - often go
relatively unnoticed, and that is where real deals
are found. Click here for more info. |
About the
Opportunistic Deal Database |
Vulture
Investors Take Note:
Looking to buy companies out of bankruptcy? Assets
of financially distressed companies in receivership,
assignment or from lenders who have foreclosed on,
and are selling, their collateral under Article 9 of
the UCC? Search for excess assets resulting from
plant closings? Targeting other sellers who need to
sell urgently and other opportunistic/special
situations?
Check out DailyDAC's Opportunistic Deal Database
(ODD). The ODD culls such opportunities.
